This bill expands the eligibility for in-state tuition rates and state-funded financial aid at public post-secondary educational institutions in New Mexico for students regardless of their immigration status. Specifically, the bill maintains the existing provision that public institutions cannot deny admission based on immigration status and clarifies that tuition rates and financial aid available to New Mexico residents must also be granted to individuals who meet certain residency and educational criteria. These criteria include attending a New Mexico secondary educational institution for at least one year and either graduating from a New Mexico high school, obtaining a high school equivalency credential in the state, completing adult education courses, or earning income in New Mexico for which tax returns were filed in the preceding two years. The bill additionally extends these benefits to individuals for whom a court has made findings related to the Special Immigrant Juvenile Classification Act and who have applied for special immigrant juvenile status. The provisions of this bill will take effect on July 1, 2025, providing a clear timeline for implementation by educational institutions in the state.
