This bill amends both the criminal procedure law and the family court act to establish a new process for notifying complainants about the service of ex parte orders of protection. Under the new provisions, complainants who are granted or seeking an ex parte order of protection can specify their preferred method of notification (such as mail, telephone, email, or other electronic communication) when the order is served on the person named in the complaint. The court is required to inform complainants of this notification right and use their specified communication method if the court has the necessary equipment. When an ex parte order is served by a police officer, peace officer, or other person, they must immediately notify the court clerk, who will then promptly notify the complainant through their chosen communication method. This bill aims to improve communication and provide more timely information to individuals seeking protection, helping them stay informed about the status of their protective orders. The new law will take effect 60 days after it is signed.
