This bill modifies requirements for pharmacy benefit managers (PBMs) seeking to do business in Oregon by mandating that they demonstrate they are not owned or operated by an insurance company or an insurance company affiliate when applying for or renewing their license. Specifically, PBMs must provide evidence to the Department of Consumer and Business Services that proves their independence from insurers during their initial application and subsequent renewals. The bill defines an "affiliate" as an entity that controls, is controlled by, or is under common control with another entity. Notably, while the new requirements are established in this bill, they will not become operative until January 1, 2031, giving PBMs an extended transition period to comply. The changes aim to ensure that PBMs, which manage prescription drug benefits for health plans, maintain independence from insurers to potentially reduce conflicts of interest and promote more transparent pharmacy benefit management practices. PBMs will still be required to submit an application, pay prescribed fees, and renew their license annually, with the added requirement of demonstrating their organizational independence from insurance companies.
