This bill amends Oregon Revised Statutes (ORS) to expand the definition of "public works" to include custom, off-site fabrication, assembly, or production of specialized goods and materials specifically intended for use in public works projects. The bill adds a new category to the existing definition that covers custom-made items not considered standard inventory, such as mechanical systems (HVAC, ducting), electrical systems, boiler systems, ornamental and structural iron work, masonry and plaster systems, mechanical insulation work, and other prefabricated modules or components created according to specific project specifications. These custom-made items will now be subject to prevailing wage requirements, meaning workers involved in their production must be paid the standard wage rate determined by the Bureau of Labor and Industries for the locality where the public works project is located. The amendments will apply to procurements solicited or contracts entered into on or after January 1, 2026, giving state agencies time to prepare for the new requirements. The bill takes effect 91 days after the 2025 legislative session adjourns, allowing for a structured implementation of the expanded public works definition.
