The bill provides sex offenders classified as level three or level two the ability to petition for reclassification to a lower risk level after specified waiting periods (typically 10 years after supervision ends), and allows these boards to grant such petitions if they determine the person presents a low or moderate risk of reoffending and does not threaten public safety. Importantly, the bill introduces flexibility by changing "shall" to "may" regarding hearings, meaning boards can now choose between holding a formal hearing or making an administrative determination. However, if the Attorney General, district attorney, or victim requests a hearing, the board must hold one. When evaluating petitions, the boards will consider factors like the nature of the original offense, time since the offense, treatment participation, employment stability, and other relevant behavioral indicators. If a petition is granted, the Department of State Police will update the Law Enforcement Data System to reflect the new classification or removal of reporting requirements.
