AN ACT Relating to wind energy facilities.

The bill defines several key terms, including "hub height" (distance from ground to the middle of a turbine's rotor) and "light-mitigating technology system" (a FAA-approved system that reduces obstruction lighting impact while maintaining aircraft visibility). Wind energy facilities must now apply to the Federal Aviation Administration (FAA) and Federal Communications Commission (FCC) for approval to install light-mitigating technology systems on turbines that require obstruction lights. Facilities are exempt from this requirement if the FAA determines the technology would be a navigation hazard, fails to respond within 12 months, or if the FCC does not provide approval. The bill will apply to wind energy facilities that apply to the FAA for a hazard determination on or after January 1, 2028.
