This bill expands health insurance coverage for Applied Behavior Analysis (ABA) therapy to include individuals with certain intellectual and developmental disabilities (IDD), in addition to the existing coverage for individuals with Autism Spectrum Disorder (ASD). The bill defines intellectual or developmental disabilities as conditions like cerebral palsy, epilepsy, and trisomy 21, or other conditions that originate before age 22, significantly impair adaptive behavior or intellectual functioning, and are not primarily attributed to other conditions. Health insurers will be required to provide coverage for screening, diagnosis, and treatment for these conditions, similar to current ASD coverage, including up to 25 hours per week of ABA therapy. The bill mandates that insurers cannot deny or terminate coverage solely based on an IDD diagnosis and allows for utilization controls and periodic review of individual treatment plans. Coverage will apply to health benefit plans issued or renewed on or after January 1, 2026, and the provisions will automatically sunset on January 2, 2030, meaning the expanded coverage will need to be renewed or reassessed at that time.
