This joint resolution proposes an amendment to the Oregon Constitution that would establish a fundamental right to a clean, safe, and healthy environment for all people, including children and future generations. The proposed amendment would require the state to protect and restore this environmental right equitably, with the highest priority given to the safety and health of children and future generations. It would allow any person to seek legal relief against state actions or inactions that could harm or threaten public safety and health interests, with courts required to consider sustainable measures like clean water, clean air, thriving ecosystems, and climate stability as compelling state interests. The resolution also specifies that prevailing parties in such legal actions would be entitled to litigation costs, including attorney and expert witness fees. Importantly, the right would be immediately enforceable upon enactment, without requiring additional implementing legislation, and is intended to strengthen existing environmental rights and remedies. The proposed constitutional amendment would be submitted to Oregon voters for approval or rejection at the next regular general election.
