This bill amends Oregon Revised Statute 163.472 regarding the unlawful dissemination of intimate images, expanding the legal definition of an "image" to explicitly include digitally created, manipulated, or altered depictions that are reasonably realistic, in addition to traditional photographic and video formats. The law continues to criminalize the intentional disclosure of intimate images without consent, with the intent to harass, humiliate, or injure another person, and maintaining the existing criteria that the depicted person must not have consented to the disclosure and would reasonably experience harassment or humiliation from such disclosure. The bill preserves existing penalty structures, treating the offense as a Class A misdemeanor for first-time offenders and elevating it to a Class C felony for individuals with prior convictions under this statute. The legislation also maintains several important exceptions to the law, such as allowing disclosures for law enforcement investigations, legal proceedings, medical or educational purposes, reporting unlawful conduct, and serving legitimate public interests. The expanded definition of "image" appears designed to address emerging technologies like deepfake imagery while preserving the core protections against non-consensual intimate image sharing.
