This bill provides a mechanism for addressing state budget shortfalls by allowing the Governor to declare an economic emergency and authorize state agencies to make staffing adjustments among management service employees. Specifically, when the Oregon Department of Administrative Services projects a state budget deficit of at least $100 million, the Governor can enable state agencies to reclassify management service employees to "at-will employment status," which means these employees can be terminated without cause. The bill requires that after the economic emergency ends, each affected state agency must conduct a review of the personnel adjustments made, evaluating the value of the adjusted positions without focusing on specific individuals who were reclassified, transferred, or terminated. The agency must then submit a report of its findings to the Governor and the Legislative Assembly. Importantly, management service employees reclassified during this process cannot use any rights (such as seniority) to replace other employees, and the at-will status applies only during the declared economic emergency period.
