This bill aims to protect the privacy of motor vehicle insurance policyholders by prohibiting insurers from using GPS tracking or location-tracking technologies to monitor an insured person's geographic location while they are driving. Specifically, the bill amends Oregon Revised Statute (ORS) 742.449 to prevent insurance companies from using any device or technology that records, discloses, or allows access to information revealing where an insured individual is when operating a vehicle covered by their motor vehicle liability insurance policy. The bill does include one important exception: insurers may obtain and use geographic location information solely for providing emergency services or roadside assistance, but only if the insured person gives affirmative consent and the insurer either provides these services directly or has an agreement with another entity to provide them. The new provisions will apply to motor vehicle liability insurance policies issued or renewed on or after the bill's effective date, which is the 91st day following the adjournment of the 2025 legislative session. This legislation is designed to protect consumer privacy and prevent potential misuse of location tracking technology by insurance companies.
