This bill modifies Oregon Revised Statute (ORS) 133.870 to expand the circumstances under which law enforcement agencies can release a person's booking photo. Currently, booking photos (photographs taken during the arrest booking process for identification purposes) can only be released under specific conditions. The bill adds two new scenarios for photo release: first, when the person depicted in the photo is a missing person, and second, upon a person's second or subsequent arrest within a 12-month period. If a person is arrested multiple times in 12 months, law enforcement can release booking photos from each of those arrests. This means that individuals with repeat arrests could have their booking photos more readily shared with the public or other agencies, potentially increasing transparency and assisting in law enforcement efforts. The bill maintains existing provisions about releasing photos for law enforcement purposes, court proceedings, victim notification, and other specific circumstances, while providing additional flexibility for photo dissemination in cases of repeated arrests or missing persons situations.
