This bill modifies Oregon Revised Statute (ORS) 455.612 to provide local governments with continued flexibility in wildfire hazard mitigation building codes. Specifically, the bill allows local governments that had already adopted and were enforcing wildfire hazard mitigation standards before July 19, 2021, to continue using their previously adopted building code standards, even if new state-level standards are introduced. The bill requires these local governments to continue adhering to the version of section R327 of the Oregon Residential Specialty Code that they most recently adopted, effectively exempting them from new state restrictions based on wildfire hazard classifications. The original law already required the Department of Consumer and Business Services to establish wildfire hazard mitigation building code standards for new dwellings and accessory structures in high wildfire hazard zones, and this amendment provides a grandfathering provision for local governments that had proactively established their own standards prior to the state's comprehensive guidelines.
