Department of Law; Address Confidentiality Program; removal of Program participant; penalty. The bill clarifies that participation in the Program shall not affect custody or visitation orders in effect prior to or during Program participation. AI Summary
This bill modifies Virginia's Address Confidentiality Program (ACP) to expand and clarify its protections for victims of domestic violence, stalking, child abduction, human trafficking, and sexual violence. The bill introduces new definitions, including "covered offense" and "covered employee," and allows employees of victim service organizations to participate in the program. Key changes include allowing program participants to be removed from the program if they reach 18 and do not recertify within 60 days, or if they initiate legal action against the Attorney General's Office. The bill explicitly states that program participation does not affect existing custody or visitation orders and does not constitute evidence of abuse. Moreover, the bill criminalizes the intentional disclosure of a program participant's confidential address with the intent to coerce, intimidate, or harass. The program continues to provide participants with a designated address to protect their actual residential, work, or school address, and maintains strict confidentiality of participant information. The bill aims to enhance safety protections for victims and those who work with victims of covered offenses by providing a mechanism to shield their personal location information from potential abusers or threats.
