This bill modifies Indiana law regarding background checks and legal liability for home health agencies and personal services agencies. It requires these agencies to conduct a national criminal history background check or expanded criminal history check on each employee who provides services in a patient's or client's residence at least annually. The bill maintains existing prohibitions on employing individuals convicted of specific crimes like rape, exploitation of an endangered adult, and theft (within the past 10 years). Additionally, the bill significantly increases potential legal penalties by mandating a $250,000 judgment against an agency if an employee with a prior criminal conviction (prohibited under the law) provides care that results in a patient's or client's death. This change aims to enhance patient safety by ensuring more rigorous and frequent background screening and creating a stronger financial deterrent for agencies that might negligently employ individuals with disqualifying criminal histories. The new provisions will take effect on July 1, 2025.
