This bill amends Tennessee's criminal code to expand the definition of aggravated assault against a first responder by creating a specific offense related to dangerous synthetic opioids. Under the new provision, a person can be charged with a Class C felony if they knowingly possess fentanyl or related substances (including carfentanil, remifentanil, alfentanil, thiafentanil, or fentanyl analogues) in a manner that could reasonably be expected to expose a first responder to the substance during the performance of their official duties, and that exposure results in serious bodily injury or death to the first responder. The bill defines "exposure" as direct contact through touch, ingestion, or inhalation, and establishes a mandatory penalty of a $15,000 fine and a mandatory minimum 90-day jail sentence, during which the defendant cannot be released. The law is set to take effect on July 1, 2025, and is designed to provide additional protection for first responders who may be at risk of accidental exposure to these dangerous and potentially lethal synthetic opioids.
