This bill creates the Electric Vehicle Motor Fuel Tax Replacement Fee Act, which will require owners of electric vehicles to pay an annual fee starting July 1, 2025. The fee amount will be calculated by first having the Department of Transportation certify its budgeted infrastructure improvement costs for the fiscal year, and then the Secretary of State will certify the percentage of registered vehicles that are electric vehicles. The annual fee will be determined by dividing the total infrastructure budget by the number of registered electric vehicles, effectively creating a road maintenance contribution from electric vehicle owners to replace the motor fuel taxes they do not pay. Each electric vehicle owner will be notified of their fee amount by October 1 and must pay by November 15 of that fiscal year. The fee proceeds will be deposited directly into the state's Road Fund. The bill defines electric vehicles using existing Illinois Vehicle Code definitions and applies various existing tax collection and administrative provisions to ensure proper implementation. The Department of Revenue will be responsible for publishing the fee amount, collecting the fees, and establishing rules for administration in consultation with the Secretary of State and Department of Transportation.
