This bill proposes to modify the cannabis law to restrict new cannabis retail dispensaries from opening within 500 feet of existing licensed cannabis dispensaries in cities, towns, or villages with a population of 20,000 or more. The measurement will be taken in a straight line from the center of the nearest entrance of the proposed and existing dispensaries. However, the Cannabis Control Board can grant an exception and issue a license for a location within 500 feet of another dispensary if it determines that doing so would be in the public interest. To make this determination, the board must conduct a public hearing with at least 15 days' written notice to the local municipality or community board. The board may also hold a public meeting about the proposed license. Importantly, if a dispensary is granted a license under these circumstances, it cannot be denied a renewal in the future based on its proximity to another licensed dispensary. The bill aims to regulate the density and distribution of cannabis retail locations while providing flexibility for potential community needs.
