Bill Summary
Amends the Notice By Publication Act. Provides that whenever a municipality is required to provide notice by publication in a newspaper by law, order of court, or contract, the municipality may publish the notice on an official municipal website instead of in a newspaper if the notice published on the official municipal website is also published electronically on a searchable online database website and that website provides independent certification of the publication. Provides conditions concerning the availability and format of the searchable online database website. Repeals a Section concerning the placement of published notices on a statewide website and makes corresponding changes throughout the Act and in the Newspaper Legal Notice Act. Effective immediately.
AI Summary
This bill amends the Notice By Publication Act to allow municipalities to publish legal notices on their official websites instead of in traditional newspapers, with several important conditions. Municipalities can now publish required notices on their official website, but only if the notice is also published on a searchable online database website that provides independent certification of the publication. The online database must be accessible 98% of the time, 24/7, and the municipal website must include a link to this database with a list of current legal notices and a search function to improve public accessibility. The bill requires that notices remain available online until the last required posting date or the event described in the notice has occurred. Additionally, if an individual cannot access the electronic publication, the municipality must provide a free paper copy at its main office. The bill also removes previous requirements for newspapers to post notices on a statewide website and updates definitions of newspapers in the legal notice statutes. These changes aim to modernize and potentially reduce the cost of publishing legal notices by leveraging digital platforms while ensuring public access to important municipal information.
