This bill addresses overcrowding and rehabilitation challenges in juvenile correctional institutions by creating a voluntary transfer process for individuals 18 years and older who are currently in facilities operated by the Department of Children, Youth, and Families (DCYF). Under the Youth Rehabilitation Pathways Act, these individuals can request transfer to the Department of Corrections (DOC), with a three-day waiting period to reconsider their decision and a subsequent 10-day transfer timeline. The legislation is based on findings that overcrowding contributes to high violence and drug use levels, and that modern brain science suggests young adults should have more agency in their rehabilitation. The transfer aims to provide better access to job programs and education, and place youth closer to their families. DCYF and DOC are required to develop a transfer request form, and individuals must be informed of this option during intake. Importantly, transferred individuals cannot remain in DOC institutions beyond their original juvenile court-imposed maximum confinement term, and standard hearing requirements for such transfers are waived. The bill is deemed an emergency measure, taking effect immediately to address urgent challenges in juvenile rehabilitation.
