This bill amends the State Property Control Act to provide specific provisions for how public universities and colleges in Illinois with aviation programs can handle transferable airplanes. The bill allows the Board of Trustees of such institutions to sell a "qualified transferable airplane" (defined as an airplane owned by the university and used for aviation instruction) to a bona fide purchaser at terms that are in the best interests of the institution. The university or college can retain the proceeds from such a sale in a separate account, which can only be used for maintaining their existing aircraft fleet or purchasing replacement aircraft. The Auditor General will examine the separate account to ensure compliance. Prior to selling an airplane, the Administrator must first determine that the agency no longer needs the airplane, it will not be used as a trade-in, and no public university has listed a need for the aircraft. The bill also clarifies existing procedures for tracking and transferring state-owned transferable property, with a priority given to transferring airplanes to universities with aviation programs.
