This bill amends North Dakota law to provide additional protections for parents who are falsely accused of child harm. If a court determines that an allegation of child harm is false and was not made in good faith, the parent who made the false allegation will be required to pay the other parent's court costs and attorney's fees. Furthermore, the bill mandates that the court order additional parenting time to the parent who was falsely accused, unless there is clear and convincing evidence against doing so. The additional parenting time must be of the same type and duration as the time previously denied, can include weekends, holidays, and summer periods, and must be scheduled within two years of the court finding the allegation false. The court is instructed to give deference to the proposed parenting time schedule of the parent who was falsely accused. This legislation aims to provide a legal remedy for parents who have suffered from baseless allegations of child harm, which may have temporarily interrupted their court-ordered parenting time.
