This bill modifies the process for filling vacancies on the Mitchell County Board of Commissioners by establishing different procedures depending on when the vacancy occurs during the term. If a vacancy happens during the first 21 months of a term, the board of commissioners must instruct the election superintendent to call a special election to fill the seat, which will be held on the earliest possible date in an even-numbered year (either during the presidential preference primary, general primary, or November general election). In the interim, the chief judge of the judicial circuit will appoint a qualified person to serve until the special election. If the vacancy occurs during the last 27 months of the term, the chief judge will instead directly appoint a qualified person to serve the remainder of the unexpired term. This legislation aims to provide a clear, structured approach to replacing commissioners who leave office before their term is complete, ensuring continuity of local government representation.
