This bill establishes a new requirement for third-party oversight of New York state procurement procedures involving minority- and women-owned businesses (M/WBEs). A third-party entity, selected by the legislature and confirmed by the chief diversity officer, will be responsible for overseeing how state contracting agencies handle M/WBE contracts. The selected entity will require quarterly submissions from each agency, including total procurement details, upcoming opportunities, bid lists, and information about contractors and subcontractors. This third-party entity must develop an evaluation system to compare each agency's performance against established M/WBE procurement goals and will be required to submit an annual report directly to the governor, senate president, and assembly speaker. The report will also be publicly available on the Empire State Development division's website. The bill aims to increase transparency and accountability in state contracting processes for minority- and women-owned businesses by implementing independent monitoring and regular reporting. The provisions will take effect immediately and will expire on the same date as the existing article governing M/WBE contracting.
