This bill modifies New York's Executive Law to allow counties, cities, towns, and villages to override a governor's declaration of a state disaster emergency within their own territorial limits. Specifically, the bill empowers local governments to limit or supersede a gubernatorial disaster emergency declaration by issuing their own local state of emergency and local emergency orders under section twenty-four of the Executive Law. These local emergency declarations can cover part or all of the local government's jurisdiction. The bill will take effect immediately but will only apply to executive orders issued by the governor on or after January 1, 2025. This legislation appears to be aimed at providing local governments with more autonomy in managing emergency situations, giving them the ability to make independent decisions about emergency measures that may differ from statewide directives.
