The bill mandates that DOT create a scoring template to prioritize pedestrian and cyclist safety, with a minimum threshold that projects must meet to be approved. The design features can include sidewalks, bicycle lanes, crosswalks, bus pull-outs, and traffic calming measures. The bill provides exceptions for projects where bicycle and pedestrian use is legally prohibited, would be disproportionately expensive, or could negatively impact public safety. It also lists specific types of projects exempt from these requirements, such as pavement preservation, bridge maintenance, and minor road improvements. Importantly, the bill does not require agencies to spend more than the allocated federal and state funding for these design features. Projects that were already 35% approved before the law's effective date will be grandfathered under the previous requirements.
