This bill removes the mandatory minimum period of post-release supervision for Class III and IIIA felonies in Nebraska. Currently, Class III felonies can be punished by up to four years imprisonment and two years of post-release supervision, with a previous minimum of nine months of post-release supervision if imprisonment is imposed. Similarly, Class IIIA felonies can be punished by up to three years imprisonment and eighteen months of post-release supervision, previously with a minimum of nine months of post-release supervision if imprisonment is imposed. The bill eliminates these minimum post-release supervision requirements, effectively giving judges more discretion in sentencing by allowing them to impose no post-release supervision for these classes of felonies.
