This bill modifies the Texas Occupations Code to enhance regulations surrounding HUD-code manufactured homes (factory-built homes that meet federal Department of Housing and Urban Development standards). The bill requires municipalities to permit the installation of new HUD-code manufactured homes in residential areas, including subdivisions, single lots, and rental communities, and mandates that applications be considered approved unless formally denied in writing within 45 days. Local governments are restricted from requiring permits, fees, bonds, or insurance for transportation and installation by licensed retailers or installers. Critically, the bill prohibits municipalities from unreasonably regulating or restricting new HUD-code manufactured home installations and prevents them from requiring specific use permits for such homes. Furthermore, municipalities with zoning regulations must now allow new HUD-code manufactured homes in at least one residential zoning classification or district type, and cannot adopt zoning rules that effectively prevent manufactured home installations across all residential zones. These provisions aim to make manufactured housing more accessible and reduce barriers to installation, with the law set to take effect on September 1, 2025.
