This bill establishes a process for transferring ownership of privately owned transportation infrastructure (such as roads, streets, and trails) to community associations in counties with less than 250,000 residents. Under specific conditions, the fee simple absolute title of these infrastructure assets can be transferred from a subdivider to a community association when: the subdivider has dissolved or ceased to exist for at least five years, no formal dedication of the infrastructure has been made to the state or county, the community association provides written notice to all adjacent property owners and relevant government entities, and no competing claims are filed within one year of the notice. The bill defines a "community association" as a nonprofit homeowners or community association existing under covenants running with the land, and a "subdivider" as the person or entity responsible for subdividing or consolidating land. The bill will take effect on July 1, 2027, and will automatically repeal on July 1, 2032, serving as a temporary measure to address ownership issues of privately owned infrastructure in smaller counties.
