AI Summary

This bill establishes new legal provisions to address the potential misuse of artificial intelligence (AI) in elections in Georgia. It creates two new criminal offenses: fraudulent election interference and solicitation of fraudulent election interference, which involve intentionally publishing materially deceptive media (AI-generated content that appears authentic) within 90 days of an election with the intent to influence election outcomes or create voter confusion. The bill defines AI-generated media and requires clear disclaimers on campaign advertisements using such content, specifying details like the creator, impersonated individuals, and the use of AI. Penalties range from misdemeanors for first-time offenses to felonies with potential imprisonment and fines up to $50,000 for subsequent violations. The Attorney General is granted concurrent jurisdiction to prosecute these cases, and the State Election Board must investigate and publicly release findings of alleged violations. The legislation includes important exceptions for First Amendment protected activities like satire, parody, and journalism, and aims to protect the integrity of elections while balancing free speech concerns by narrowly targeting deceptive media created in bad faith to manipulate electoral processes.
