This bill prohibits the licensing of three types of residential care facilities - adult residential care homes, expanded adult residential care homes, and developmental disabilities domiciliary homes - if they are financed, managed, operated, supervised, directed, or owned in whole or in part by an individual convicted of gambling offenses under Chapter 712, Part III of Hawaii's laws. Specifically, the bill amends three existing sections of Hawaii's Revised Statutes to add identical language preventing licensure for facilities with such ownership or management by individuals with gambling-related criminal convictions. The bill aims to ensure that individuals with a history of gambling offenses cannot operate or have significant control over residential care facilities that provide housing and support for vulnerable populations, including elders, persons with disabilities, mentally ill individuals, and people with developmental disabilities. The new provisions are designed to protect the health, safety, and welfare of residents by preventing potential exploitation or financial misconduct by individuals with a history of gambling-related criminal activity. The bill will take effect immediately upon approval.
