Bill Summary

This bill relates to the dissemination and exhibition of obscene material to minors. Current law provides that any person, other than the parent or guardian of the minor, who knowingly disseminates or exhibits obscene material, including the exhibition of obscene material so that it can be observed by a minor on or off the premises where it is displayed, commits a serious misdemeanor. The bill increases the penalty to a class “D” felony. A class “D” felony is punishable by confinement for no more than five years and a fine of at least $1,025 but not more than $10,245. A violation of Code section 728.2 is a tier I sex offense and a person convicted of the offense is required to register as a sex offender for a period of 10 years.

AI Summary

This bill modifies existing Iowa law regarding the dissemination of obscene material to minors by changing the criminal penalty for such an offense. Specifically, the bill elevates the punishment for knowingly showing obscene material to a minor from a serious misdemeanor to a class "D" felony. Under the proposed change, any person (except a parent or guardian) who intentionally displays or provides obscene material to a minor, whether in person or through a method that allows a minor to observe the material, would be subject to more severe criminal consequences. A class "D" felony in Iowa is typically punishable by up to five years in prison, which represents a significant increase in potential penalties compared to the previous serious misdemeanor classification. The bill aims to strengthen legal protections for minors by imposing a more stringent punishment for individuals who expose children to obscene content.
