Specifically, the Tennessee National Guard cannot be released from state military service into federal active duty combat unless the U.S. Congress has either officially declared war (as permitted by Article I, Section 8, Clause 11 of the U.S. Constitution) or has explicitly called forth the Guard for specific constitutional purposes like executing union laws, repelling an invasion, or suppressing an insurrection. The governor is required to take all necessary actions to comply with this restriction. However, the bill does not prevent the governor from consenting to National Guard deployments for domestic civil authority missions within the United States and its territories, as outlined in Title 32 of the U.S. Code. The legislation would take effect immediately upon becoming law.
