This bill amends Mississippi law to define and regulate nonemergency medical transportation (NEMT), establishing clear standards for providers and vehicles that transport individuals who need medical transportation but are not experiencing an emergency. The bill defines NEMT as transportation services for individuals with a health-related transportation need who do not require an ambulance, and it requires the State Department of Health to adopt rules for permitting, driver qualifications, and vehicle safety standards. These standards include comprehensive background checks for drivers (including fingerprint and criminal background checks), drug screenings, vehicle safety inspections, and minimum insurance requirements. The bill provides some exceptions to the permitting requirements, such as for Medicaid providers working with transportation brokers who conduct their own inspections, and for Transportation Network Companies providing transportation to ambulatory individuals. NEMT providers must meet all departmental standards, can be fined or have their permits revoked for non-compliance, and are subject to potential injunctions if they operate without proper permits. The new regulations will take effect on July 1, 2025, giving transportation providers time to prepare for the new requirements.
