This bill establishes a comprehensive product stewardship program for primary batteries (non-rechargeable batteries like alkaline, carbon-zinc, and lithium metal batteries) in New York State. Starting January 1, 2027, battery producers must register and submit a stewardship plan to the Department of Environmental Conservation that includes free collection points across the state, with at least two permanent collection facilities in less populated counties and more locations in densely populated areas. Producers must provide free battery collection at retailers and municipalities, ensure responsible recycling of collected batteries, and develop an education and outreach program to inform the public about battery recycling locations and procedures. Each producer will pay an annual administrative fee ($7,500 for individual producers, $15,000 for cooperative producers), and must submit an annual report detailing collection rates, collection facilities, and program costs. The plan also requires an independent third-party audit every five years to assess program effectiveness. Retailers will be prohibited from selling primary batteries from producers not participating in an approved stewardship plan, with some exceptions for existing inventory. Producers who violate the requirements may face civil penalties of up to $1,000 per day of non-compliance, and the Department of Environmental Conservation will maintain a website listing approved producers and their brands.
