This bill amends Delaware law to enhance the Auditor of Accounts' subpoena powers by removing the previous requirement to file a praecipe (a formal request) with the county prothonotary before issuing a subpoena. Instead, the Auditor can now directly subpoena witnesses, compel their attendance, administer oaths, and require the production of documents and evidence needed for their official duties. The bill also expands the methods of serving subpoenas, allowing service by personal delivery, leaving the subpoena at a person's residence with a suitable adult, or sending it by certified mail. For corporate entities, service can be made on the registered agent or an authorized representative. Additionally, if a subpoena recipient fails to respond, the Auditor can now apply to the Superior Court for an order compelling compliance, and failure to obey such a court order can be punished as contempt of court. These changes aim to streamline the Auditor's investigative processes and provide more direct enforcement mechanisms.
