This bill amends Indiana real estate law to require licensed real estate brokers representing sellers to provide specific radon-related disclosures when selling residential property. Before a purchase agreement is signed, the seller must provide a written warning statement from the Indiana Department of Health that strongly recommends radon testing, explains the health risks of radon (a Class A human carcinogen linked to lung cancer), and notifies potential buyers that the property may expose occupants to dangerous radon levels. The seller must also disclose in writing any known radon test results, test records, concentration levels, mitigation efforts, and details about any existing radon mitigation systems. Additionally, the seller must provide the buyer with a radon guide published by the Indiana Department of Health. These disclosure requirements apply to all types of residential real estate transfers, including sales, exchanges, leases with purchase options, and other transfer methods. The buyer must acknowledge receipt of these disclosures by signing a notification. The bill aims to increase transparency about radon risks and help potential homebuyers make informed decisions about property purchases.
