This bill creates a new legal provision that allows civil action against individuals or entities who intentionally obstruct or create dangerous conditions on public highways. Specifically, the bill establishes that anyone who deliberately interferes with or makes a public highway dangerous can be sued for damages by an injured party, and the plaintiff can also recover reasonable attorney fees and costs. The bill defines "person" broadly to include individuals, private entities, state agencies, and political subdivisions. It also includes a provision that if the obstructive conduct could be considered both a civil violation and a criminal offense under existing law (specifically section 609.74, clause 2), a state agency or political subdivision must choose either a civil action or criminal prosecution, but cannot pursue both for the same incident. The bill provides an exemption for actions taken by law enforcement, emergency responders, road or airport authorities, and utility officials when they are performing their legally mandated duties. The new law would take effect on August 1, 2025, and would apply to causes of action arising on or after that date.
