This bill prohibits the sale, manufacture, and distribution of medical solution containers and medical tubing in New York that are made with polyvinyl chloride (PVC) or intentionally added Di(2-ethylhexyl) phthalate (DEHP), a type of chemical used to make plastics more flexible. DEHP is defined as a chemical that a manufacturer intentionally adds to a medical product for a functional or technical purpose. The bill also sets a limit of 0.1 percent by weight for unintentionally added DEHP, meaning DEHP that is present in the product but not intentionally added for a specific function. Furthermore, the bill prevents manufacturers from replacing DEHP with other ortho-phthalates, which are a class of chemicals similar to DEHP, in revised or new products. These restrictions will take effect on January 1, 2030, for medical solution containers and January 1, 2033, for medical tubing, with the act itself becoming effective immediately upon passage.
