This bill modifies Wyoming state law regarding ballot initiative procedures by removing a provision that previously allowed the attorney general to void a ballot initiative petition if the legislature had already passed a substantially similar law. Under the current law, if the legislature enacts an act that is deemed substantially the same as a proposed ballot initiative after the petition is filed, the petition could be declared void and prevented from appearing on the election ballot. The proposed bill eliminates this provision, which means that even if the legislature passes a similar law after a ballot initiative petition is filed, the initiative can still proceed to the ballot. The bill will take effect on July 1, 2025, and specifically amends Wyoming Statute 22-24-319, which governs when and how ballot propositions are placed on election ballots. By removing the language that allows voiding a petition, the bill preserves the ability of citizens to pursue ballot initiatives regardless of concurrent legislative action.
