This bill amends Maryland's natural resources law to require additional notification procedures for individuals seeking to remove roadside trees. Specifically, when applying for a permit to cut down or trim a roadside tree (defined as any tree or shrub growing within a public road's right-of-way), the applicant must now provide notice by certified mail to two groups: (1) all property owners whose land abuts or is adjacent to the property where the tree is located, and (2) the governing body of any common ownership community that controls the land where the tree is situated. The notice can be either a copy of the permit application or information about how to electronically access the application. Notably, the bill clarifies that properties separated by a highway or public right-of-way are still considered "abutting and adjacent" for notification purposes. The bill maintains existing provisions about when permits are required or not required for tree removal, such as exceptions for emergency situations or unimproved roads, and preserves penalties for unauthorized tree removal (up to $2,000 for a first offense and $5,000 for subsequent offenses). The new notification requirements will take effect on October 1, 2025, providing time for affected parties to prepare for the change.
