This bill modifies the existing law regarding the Waterways and Ports Trust Fund by establishing clearer guidelines for its use and management. The fund, which will be housed in the state treasury, can receive revenues appropriated by the general assembly as well as gifts, contributions, grants, or bequests from various sources. The bill specifies that the fund is a revolving trust fund exempt from standard state treasury transfer rules, with all earned interest remaining in the fund. Moneys can be withdrawn only at the request of a Missouri port authority for statutorily permitted port purposes and upon general assembly appropriation, to be administered by the state highways and transportation commission and department of transportation. To be eligible for funding, projects must meet specific criteria, including being capital improvement projects that enhance commerce or transportation facilities near navigable rivers, located on port authority or specific city-owned land, funded by multiple sources (with trust fund money comprising no more than 80% of project costs), approved by the highways and transportation commission, and capable of completion within two years. The bill also allows fund appropriations to be used as a local match for other grant programs and includes a sunset provision that will dissolve the fund on December 31, 2033, with any remaining balance transferred to the general revenue fund.
