This bill amends the New York State Lien Law to add more comprehensive notice requirements for self-storage facilities when enforcing liens on stored goods. The bill requires that occupancy agreements now include the active telephone number of the occupant and provides additional notification protocols. Specifically, the bill mandates that self-storage facilities must attempt to contact the occupant via telephone (including text message) when sending legal notices about potential lien enforcement, in addition to traditional mail and electronic notification methods. The agreement must now include conspicuous notices informing occupants about charges, the option to receive legal notices electronically, and the facility's obligation to attempt telephone contact. If an occupant does not provide or update their telephone number, they waive the right to telephone notification, but this does not affect the facility's other legal remedies. The new requirements aim to improve communication between self-storage facilities and occupants during the lien enforcement process, giving occupants more opportunities to be informed about potential actions against their stored goods. The law will take effect 180 days after becoming law and will apply to new occupancy agreements entered into after that date.
