Bill Summary

AN ACT RELATING TO CRIME; INCREASING THE PENALTY FOR AGGRAVATED BATTERY UPON A PEACE OFFICER.

AI Summary

This bill increases the criminal penalties for aggravated battery committed against peace officers by modifying existing New Mexico law. Specifically, the bill changes the degree of felony for certain types of aggravated battery against a peace officer. For cases where the battery causes painful temporary disfigurement or temporary loss of bodily function, the offense remains a fourth-degree felony. However, for more serious instances involving great bodily harm, use of a deadly weapon, or methods that could potentially cause death or great bodily harm, the bill upgrades the offense from a third-degree to a second-degree felony. The bill also updates gendered language, replacing "he" and "his" with gender-neutral terms like "the officer" and "the officer's". The changes will take effect on July 1, 2025, and are designed to provide stronger legal protection for peace officers who are injured while performing their official duties.
