AI Summary

This bill introduces the "Kratom Consumer Protection Act", which establishes comprehensive regulations for kratom products in Montana. The legislation defines kratom as the Mitragyna speciosa plant and sets strict guidelines for its processing and sale, with a primary focus on protecting consumers, particularly those under 21 years old. The bill prohibits kratom processors from preparing, distributing, selling, or exposing for sale kratom products that contain more than 2% 7-hydroxymitragynine in the alkaloid fraction, include synthesized materials, are adulterated with dangerous non-kratom substances, or are combustible, vaporizable, or injectable. The act specifically protects entities that serve fresh, non-synthesized kratom products and prevents state and local governments from prohibiting such businesses. Importantly, the bill provides clear definitions for terms like "kratom extract" and "synthesized material" to ensure precise regulation. The legislation is set to become effective on June 1, 2025, and will be codified under Title 30, chapter 14 of Montana state law, demonstrating a comprehensive approach to regulating this plant-based substance.
