This bill introduces the "Tennessee Homebuyer Harassment Prevention Act," which aims to protect property owners from excessive unsolicited purchase offers. Under the new law, real estate developers, businesses, and their representatives are limited to contacting a property owner only once per calendar year with an unsolicited offer to buy their property, regardless of the communication method (phone, text, email, mail, etc.). When making such a contact, the solicitor must provide their full legal name, operating address, contact phone number, and email address. Property owners who believe a violation has occurred can file a complaint with the division of consumer affairs, which must review the complaint within 20 business days and provide a written response. Violators can be subject to civil penalties of up to $2,000 per violation, and the law specifically prohibits using misleading caller ID information to circumvent these restrictions. The bill includes exceptions for licensed real estate agents and government agencies, and will take effect on July 1, 2025, applying to prohibited conduct occurring on or after that date. The legislation is designed to reduce unwanted property purchase solicitations and provide consumers with more control over unsolicited business communications.
