This bill establishes a new article in Arizona law regarding effluent compensation for water customers in active management areas. The bill requires municipal water providers with an exclusive service area to compensate eligible customers for a proportional share of the full market value of effluent (treated wastewater) that is not recharged back into the customer's active management area. An "eligible customer" is specifically defined as a customer in an active management area where the municipal provider owns the wastewater system, provides potable water, and charges for wastewater service. Before billing customers, municipal providers must calculate several detailed metrics, including the total volume of wastewater received, effluent produced, and effluent recharged. Customers will receive a bill credit equal to their proportional share of the full market value of effluent not recharged in their area. The bill also provides enforcement mechanisms, allowing customers to submit written complaints to the director or file private legal actions challenging the provider's calculations, with potential damages, attorney fees, and interest awarded if miscalculations are found.
