This bill grants perpetual easements for county and municipal roads that existed before January 1, 2025, across state and school lands at no cost to the counties, cities, or road users. The bill defines "county road" as a road established or maintained by county commissioners and "municipal road" as a road established and maintained by a city or town. By August 1, 2025, the director must provide the board of land commissioners a comprehensive list of all such roads on state lands, and by October 31, 2025, the board must create rules for these easements and distribute a list to all counties and cities. Each county and city must provide complete documentation for these road easements by April 1, 2030, after which the board will officially record the easements with the county clerk. Importantly, the bill does not automatically grant easements for any roads constructed after January 1, 2025, which will need to secure rights-of-way through standard legal processes. The bill also makes a technical amendment to update a statutory definition to include the new section of law.
