This bill aims to improve language access in elections by requiring county auditors in certain counties to provide election-related materials in languages spoken by significant language minority groups with limited English proficiency. Specifically, a county will be considered a "covered county" if at least 2.5% of voting-age citizens belong to a single language minority group (defined as American Indian, Asian American, Alaskan Native, or Spanish heritage) with limited English proficiency, and the group's illiteracy rate exceeds the national average. The bill applies to counties with significant minority populations or those containing Indian reservations. The Secretary of State will determine these language minority groups every five years using census data and American Community Survey information, and must notify counties of their designations. Counties will have 365 days to implement the new language requirements after designation. The bill also establishes a grant program to help counties cover the costs of providing translated election materials. Materials must include registration forms, voting notices, instructions, ballots, and other electoral process information. Importantly, these requirements are in addition to existing language access laws. If specific funding is not provided by June 30, 2025, the entire act will become null and void.
