This bill introduces a new requirement for landlords in Arizona to offer tenants the option of having their rental payments reported to a consumer credit reporting agency. Landlords must provide this written offer at the beginning of a tenancy and annually thereafter, including specific details such as the credit reporting agency's name, the optional nature of reporting, and that all payments (timely, late, or missed) will be reported. The written offer must include instructions for opting in or out of reporting, and a place for the tenant to sign. Tenants can opt in at any time after receiving the initial offer and can also opt out, but must wait six months before opting back in. Landlords may charge a fee of up to $10 per month or their actual cost for reporting, but this fee cannot be considered a rent payment, cannot be grounds for terminating the rental agreement, and cannot be deducted from the security deposit. If the tenant does not pay the reporting fee for more than 30 days, the landlord can stop reporting rental payments. The overall aim of this bill is to provide tenants with an opportunity to build credit through consistent rental payments.
